Customer Agreement of Paycestra
- Legal Basis
This Agreement is governed by:
The Revised Payment Services Directive (EU) 2015/2366 (PSD2),
The General Data Protection Regulation (EU) 2016/679 (GDPR),
Applicable national laws and regulations of the Republic of Estonia, including oversight by the Estonian Financial Supervision Authority (Finantsinspektsioon).
- Services Provided
Payment processing,
Payment control and refund,
3D Secure payments,
Payment verification and risk checks,
Card storage and recurring payments,
Other payment-related services as agreed between the Parties.
- Identity Verification (KYC/AML)
Identity verification is required using e-Resident ID, Smart-ID, or Mobiil-ID. Paycestra shall commence the provision of payment acceptance services only after the Merchant has submitted all necessary information and documentation requested by Paycestra for Know Your Customer (KYC) and Anti-Money Laundering (AML) compliance and risk assessment.
- Fees and Commissions
All applicable fees, including but not limited to transaction fees, currency exchange margins, and monthly maintenance charges, are transparently disclosed in the pricing schedule.
- Data Protection (GDPR)
All personal data is processed in compliance with the General Data Protection Regulation (GDPR). Data will be retained for a period of 5 years, or longer if required by applicable law.
- Rights and Obligations
The Merchant is solely responsible for safeguarding their login credentials and any activity performed under their account. Any unauthorized access or use must be reported to the Company immediately.
- Duration and Termination of the Agreement
This Agreement is concluded for an indefinite term. Either party may terminate the Agreement by giving one (1) month’s written notice.
8. The Validity of the General Terms and Conditions
These General Terms and Conditions shall replace any previous versions and any other provisions applied between the Supplier and the Merchant when they enter into force.
